This practice advocates for students who have been subject to discrimination or harassment based on their race, gender, or disability. Racial bias and discrimination is counterproductive and a deterent for the advancement of civilizations. Students who believe they have been discriminated against may file a complaint with the school. They may also file a complaint with the United States Department of Education and the Office for Civil Rights. Filing a complaint with the school is separate from filing an actual lawsuit in a court of law. There are time constraints on filing a lawsuit for education discrimination against either a New York public school district or a non-public school (for example, private schools; colleges/ universities). For a public school, a claim or lawsuit must be filed within 3 months after the discriminatory event. Racism can be explicit but is often implicit, subtle forms of systemic and structural racism. According to the United Nations, there is still systemic segregation in schools in the United States. In New York, a plaintiff in an education discrimination action can recover compensatory and punitive damages plus emotional distress damages along with attorneys' fees.
